Arrest Made in Kidnapping and Sexual Assault Case

Palo Alto CA - On October 30, 2007, at approximately 3pm, a 17 year-old victim was kidnapped on the 500 block of Arastradero Road in Palo Alto. At 4:10pm, the victim escaped from the suspect vehicle, when the driver stopped in the 500 block of Fair Oaks Avenue in Sunnyvale.  

A passing motorist observed the victim running down the street and stopped to assist.  Motorist Fred Burgener immediately called 911 and remained with the victim until police arrived. 

Palo Alto Police and the Sunnyvale Department of Public Safety worked the two crime scenes around the clock for the next three days.  

While working the investigation, Palo Alto Police Detectives received valuable information from Palo Alto Police Officer Eric Bulatao.  The information provided by the officer led detectives to San Jose, where the suspect was located and arrested.  

On November 1, 2007, at approximately 10:30pm, suspect Todd David Burpee (5/12/87), was arrested without incident and was booked into the San Jose Main Jail.  He was charged with attempted murder, assault with a deadly weapon, kidnapping, and two counts of sexual assault. 

This arrest was the result of tremendous community cooperation and thorough "old-fashioned" police work on the part of many agencies including the Palo Alto Police Department, Palo Alto Police Crime Scene Investigators, Sunnyvale DPS, Mountain View Police, San Mateo and Santa Clara County Parole and Probation, the Santa Clara County Crime Lab, the Santa Clara Office of the District Attorney, the U.S. Marshall’s Office, and San Jose Police.    

Palo Alto Police also praise the victim for her courage and fortitude to be able to provide investigators with essential clues and information that aided police in locating the suspect.  The victim demonstrated amazing heroism despite the horrible circumstances she endured. 

Palo Alto Police want to assure the public that their children are much safer as a result of this arrest.  However, parents and school officials should always encourage their children and students to always practice stranger awareness and to travel in groups when possible.
