The Annual Office Limit Ordinance proposes permanent Zoning Ordinance amendments to continue the limit on the annual office/R&D development to 50,000 square feet of net new floor area.

BACKGROUND

Origins of the Interim Ordinance

On September 21, 2015, the City Council adopted an interim ordinance establishing an annual limit on the amount of net new office/R&D space that can be approved each fiscal year in specified areas of the City that include Downtown, the California Avenue area, and the El Camino Real Corridor. As part of the implementation of the ordinance, administrative procedures were reviewed by Council and established in February 2016. The interim ordinance was extended for an additional seven months and will expire on June 30, 2018. Links to the related Council staff report and guidelines are provided below.

The Annual Office Limit ordinance has the effect of pacing annual development in the affected area and establishes preferred project criteria in the development (e.g. high quality design, mixed uses with substantial housing, no parking impacts). Future Zoning Amendments

Staff will be going to the Planning and Transportation Commission (PTC) and the City Council for direction on modification for the permanent ordinance. There will be several public hearings on this matter during the course of developing and adopting a the new ordinance. At this time, the next step it to return to the PTC in early Spring 2018 with a draft ordinance and, shortly thereafter, go the City Council for review and action.
